General Information
Under the terms of the consent decree, Terumo CVS has agreed to restrictions on the distribution of certain products manufactured at the Ann Arbor facility while it completes the terms outlined in the decree.
Generally speaking, Terumo CVS has agreed that it will only sell or support products manufactured at the Ann Arbor facility (which include heart-lung machines and cannulae) to customers that:
- Already use the products, and
- Have signed a Certificate of Medical Necessity. A copy of the Certificate is appended to the Notification Guides.
- Customers in the U.S. must have signed the Certificate within 45 days of the effective date of the consent decree, or by May 13, 2011.
- Customers outside the U.S. must sign the Certificate prior to placing an order for the affected products. NOTE: These customers must have already used the products prior to the effective date of the decree, or March 29, 2011.
